The Owner of the reserved property, by and through Siebert Realty as Agent, rents to Guest(s) and
Guest(s) rent from Owner for
the specified period on the following terms and conditions as part of the Siebert Realty Lease
Agreement (the βLease Agreementβ).
For the purposes of this Lease Agreement, the terms Guest/Tenant, Owner/Agent/Landlord, and
Lease/Reservation are
interchangeable and do not alter the Tenant/Landlord relationship created herein. The term βGuestβ
shall mean and include all
Guests who are occupying the property under the Lease Agreement, and all of Guest(s)β family
members, invitees, visitors,
employees and agents who enter, use or are on the property.
1. Reservation Payment(s)
By submission of Lease Agreement, either electronically via Siebert Realty GuestNet or per
hard copy, and tender of payment listed on agreement plus Optional Travel Insurance by the indicated due date, Guest acknowledges that they have rented the property on the Lease Agreement for the dates and rates
indicated; and, that have read, understand, and agree to the Terms and Conditions of the Lease Agreement and any included waivers. If payment is not received,
reservation will be cancelled without further notice. All payments must be made in U.S. Funds.
METHOD OF PAYMENTS: Payments may be made electronically at www.siebert-realty.com by clicking on the
βMake A Paymentβ button at the bottom of the home page. We also accept Personal Checks, Cashier's Checks, Money Orders,
Wire Transfers, and Cash. Payments must be received by the due date indicated on your Lease
Agreement. Credit Cards are processed by a third party. Personal Checks are accepted only when payment is received 30 days
prior to arrival. $30 will be charged for all returned checks. If you prefer to wire funds directly from your account,
please contact our Rental Department for instructions. **For Canadian/Overseas Guests paying by Check, please make sure
it is drawn on a U.S. Bank, or certified U.S. Funds, and that it has U.S. funds printed on the check (not hand-written).
You may also utilize the wire transfer method mentioned above. Agent reserves the right, in its sole discretion,
to require a specific payment method.
If a reservation is made less than 40 days prior to arrival, the Total Balance is due in full and
payment must be received
within the following time frames:
- a. Reservations placed from 40 to 15 days from arrival: Cashierβs Check, Money Order, Credit
Card (MC / VISA /
DISCOVER / AMEX), Wire Transfer, eCheck, or Cash payment due within 2 Days:
- b. Reservations placed 14 days or less from arrival: Cashierβs Check, Money Order, Wire
Transfer, or Cash ONLY due
within 1 Day.
2. Refundable Security Deposit
All reservations 21 days or more but less than 90 days require a $500 Refundable
Security Deposit. Our staff will inspect each unit after it is vacated and if retention of any funds
from deposit is necessary due to
damage or additional cleaning, a copy of the documentation will be sent to Guest. Guest will be
responsible for all damages to
include but not limited to: missing articles; excessive cleaning; wear and tear due to exceeding the
occupancy limit specified;
furniture moved from room to room; not checking out on time; etc. It is not our intent to retain
anyoneβs deposit; however, cost of
any preceding acts, at Agentβs discretion, shall be charged to Guest. If cost of damage exceeds the
Security Deposit amount
listed above, Guest is fully responsible and will be billed for the additional charges. If there is
no unusual cleaning required or
damage of any kind incurred by Guest, Security Deposit will be fully refunded back to the original
form of payment within 45 days
of departure date.
3. Cancellations
All cancellations must be in writing β email notification is acceptable. All monies paid by Guest, LESS
a
cancellation fee of 18% of the total rent, will be refunded ONLY IF the property is re-rented for the
same rate and time. In an
attempt to get the property re-rented, discounts may be offered and guest would be responsible for any
difference in rent between
the original rate and the reduced rate. Paid in full reservations may be discounted at the discretion of
the guest up to 50%. If the
property is not re-rented, Guest will not receive a refund regardless of reason. If Guest makes a change
or transfer within the
same year on a confirmed reservation, a $40 transfer fee is required provided original reservation is
re-rented for same rate and
time. For details of our cancellation policy, see our website. A Travel Protection Plan is available at
the time of booking and is
highly recommended.
4. TRAVEL PROTECTION PLAN
A protection plan covers cancellations due to "unforeseen circumstances" such as job loss,
unexpected illnesses, deaths, or mandatory evacuations in the event of a hurricane. Restrictions do
apply. Please review our
cancellation procedure carefully before making your decision. The Travel Protection Plan is completely
optional; however, the
Travel Insurance cost is included on your lease in your FIRST PAYMENT for your convenience. Please MARK
THE
APPROPRIATE BOX indicating if you wish to purchase the insurance. If you accept this insurance by
including the premium with
your first payment, understand that refunds will not be issued after payment has been received and you
must deal directly with
the Insurance Company, not Siebert Realty, if a claim becomes necessary. In all cases, Guest must notify
Siebert Realty in writing
in the event of a cancellation. For questions concerning the Travel Protection Plan, call Generali

5. FAMILY GROUPS ONLY / OCCUPANCY LIMIT
We are instructed by our Owners to rent to FAMILY GROUPS ONLY.
A βFamily Groupβ is defined as parents, grandparents, children and extended family members
vacationing in one home. A
βNon-family Groupβ is defined as: unmarried young adults, high school or college students, or any
other group-type situation.
Non-family Groups are asked not to apply for accommodations. IDβs must be furnished upon request.
The leaseholder
must be at least 24 years old and understands that he/she must personally occupy the property for
the entire period. We
lease homes without respect to the race, color, religion, sex, handicap, familial status, national
origin, sexual orientation,
gender identity or elderliness of any party. Sandbridge Beach is a family-oriented community;
therefore, loud parties are
prohibited. Per the Short-Term Rental Zoning Ordinance issued by the City of Virginia Beach, the
number of persons
(occupancy limit) in a rental property cannot exceed the number of bedrooms times 3. Some properties
have a lower
occupancy than the ordinance will allow, and it is listed in the property description.
Misrepresentation, exceeding occupancy
limit in the overall property, or as stated on each deck, stairs, and porches; or, loud house
parties are considered default
under paragraph #28 sub-section i resulting in Guests being asked to immediately vacate property
without refund.
6. ARRIVAL
CHECK-IN TIME IS AFTER 4:00PM. Please plan your check-in day accordingly for arrival after 4:00PM. We
must have until that time to prepare all rental properties for the next check-in. Every effort is
made to ensure all units will be ready
by 4:00PM; however, in some cases it may be necessary to delay check-in until the unit is completely
ready (there are no rebates
for late occupancy). Arrival at the property means - youβre βON VACATIONβ! ENJOY!
7. DEPARTURE
CHECK-OUT TIME IS BEFORE 10:00AM. - Upon Check-out, please leave property in orderly condition:
dishes washed, refrigerator emptied, etc. IMPORTANT: Tuesday is trash collection day. During the
summer months, Saturdays
are added for trash pickup and Guests must take the trash out to the street either Friday night or
by 7:00AM Saturday morning so
container is left empty for the next family. Failure to leave property in an orderly condition, take
trash to street, or vacate property
and return key(s) by 10:00AM could result in an additional charge to guest.
8. LINENS
ALL GUEST RESERVATIONS INCLUDE LINENS WITH BEDS MADE β Complimentary Linens with beds made
are provided for all taxable guest reservations. In addition, towel sets for the total unit limit
(bath towel, hand towel and wash
cloth), a Kitchen towel set (2 towels), and a Bathmat for each Full Bath are provided. Rental
properties do not include soap, trash
bags, or paper products. There are pillows and bedspreads on all beds. Please note that upper bunk
beds are not made.
9. MONIES RECEIVED
All monies received by Siebert Realty from Guest including gross rent, security deposit (for
reservations
21 β 89 days), travel insurance cost, and lodging tax may be placed in an interest-bearing escrow
account. All deposits will be
held by Agent. Agent will retain any interest on amounts held by Agent. Interest shall not be paid
to guest on any monies received
by Agent. Agent is entitled to any commission upon receipt of payment and may be deducted from the
initial deposit.
10. ANIMALS
Pets are accepted at select properties only and are not allowed at any of our condos. Those
properties that do
are indicated with βPets Allowedβ and require a non-refundable pet fee of $100 (for each pet / limit
- 2 pets unless otherwise noted
in house description) to aid in cleaning/fumigation expenses. Pets are only allowed with Agent's
specific written approval in
advance and pet fee paid. Any unauthorized pet on premises shall result in automatic forfeiture of
all monies paid and immediate
eviction without refund. Pets must be kept on cottage premises. City ordinance prohibits pets being
walked without a leash or
running loose on beach. From Memorial Day to Labor Day pets are only allowed on the beach before
10:00AM and after 6:00PM.
Please clean up and dispose of any mess your pet makes on the beach as well as around the rental
property. All Guests, including
those with pets, should be cognizant of the efforts in keeping Sandbridge a peaceful community.
Please keep noise down after
10:00PM.
a. Guests seeking to bring assistance animals into properties may request an accommodation for the
assistance animals
on the Assistance Animal Request Addendum. The Assistance Animal Request Addendum must be completed
and
submitted sufficiently in advance of the commencement of the reservation to allow Agent and Owner a
reasonable period
of time to evaluate the information set forth in the request. Any misrepresentation, omission or
other falsehood on the
Assistance Animal Request Addendum will be a material breach of this Lease Agreement and subject
Guest to automatic
forfeiture of all monies paid and immediate eviction from the property.
11. AFTER HOURS LOCKOUTS β Please keep your keys with you at all times. If you lock yourself out
βafter hoursβ, you will
incur a $20 fee payable when youβre met at the office by a Siebert Realty employee or a $30 fee if
keys must be delivered to the
home. Key service is available until 11:00PM.
12. GRILLS / FIREPLACES
Grilling and other outdoor cooking on upper wooden decks of rental property is prohibited. All
grilling and other forms of outdoor cooking should be done outdoors on the ground level of your rental
property, and not in any
garages, porches, breezeways, sheds or other enclosed areas. Grilling is not allowed on condo balconies.
Fireplace use is
allowed from October through April unless otherwise noted in online property description. Please do not
use fireplaces in high
wind conditions.
13. OWNERβS CLOSET
Most of our Owners have a locked βOwnerβs Closetβ for their own personal use. Please respect these
closets; they are not to be tampered with or opened under any circumstances.
14. MAINTENANCE
All equipment in each property should be in working order. Please report any inoperative equipment to
our
office promptly! We will make every effort to have repairs made as soon as possible. Owner and Agent
shall have the right to inspect
and make repairs to the property during the rental period. Guest is prohibited from making any
alterations to the property whatsoever
and from bringing additional appliances or other personal items to the property that might damage
the property or cause excessive
use of utilities, without prior written consent of the Agent or Owner. Guest agrees to pay promptly
for any unnecessary maintenance
calls, excessive use of utilities, or damage caused by unauthorized items at the property. Excessive
use of utilities is defined as
more than one and one-half times the average cost for the utility in question of the subject
property for the quarter of the year the
rental takes place. Guest shall notify Agent immediately of any fire or other casualty that occurs
on the property.
15. REFUNDS - No reduction of rent, rebate, or refund will be issued for mechanical failure of
air-conditioning, major or minor
appliances, public utility interruptions, ongoing construction near rental unit, or Guest
dissatisfaction. Maintenance repairs will be
made as promptly as possible. Refunds will not be issued for errors in brochure, website, or
reservation agreement, or changes
made by Owner in property including but not limited to bedding, furnishings, equipment, etc. No
refunds will be issued for inclement
weather, including heat waves or hurricanes. Some pools are heated by a solar system and they
typically have the potential for
the water temperature to get 8 β 12 degrees warmer than an unheated pool. We cannot guarantee any
particular water
temperature and no refunds will be made for uncomfortable swimming conditions. We have heard that
occasionally, a mild ground
current has been experienced in some pools in Virginia Beach. This appears to be the result of the
Earthβs own natural electrical
current rather than a pool defect or household current. Locations of certain properties may be
affected more than others and the
currents tend to be intermittent. We want to advise you that certain devices such as pacemakers and
other similar devices may
be affected. Please follow all safety instructions. For questions concerning the Travel Protection

16. ERRORS
Every effort has been made to assure all information is accurate; however, descriptions,
rates, property amenities,
and taxes listed in brochure, on the website, or on this Lease Agreement are subject to change without
notice. Omissions,
additions, or errors, as well as changes made by Owner in property bedding, furnishings, equipment,
etc., or changes in tax rates
made by state and local taxing authorities, shall not be the responsibility of Agent, Owner, or Printer.
17. ITEMS LEFT BEHIND
Items left at the property by Guest are not the responsibility of Owner or
Agent. Please double check
for all personal items before departure. A minimum $20 fee will be required to return by mail any items
left in the property.
18. PROPERTY RESERVED
Every rental property is privately owned and reflects each ownerβs personal
taste. Property
reserved sight unseen is represented by Agent as realistically as possible with regards to space,
physical condition and
comparisons. We advise you to view the propertyβs interior photographs on our website at
www.siebert-realty.com if you have
specific personal requirements or are concerned with quality, as we are unable to make substitutions or
refunds upon arrival.
19. PROPERTY UNAVAILABILITY
Due to unforeseen circumstances if your property becomes unavailable or
uninhabitable,
Siebert Realty reserves the right to move you to a comparable property. Every effort will be made to
place you in a property that
has a comparable location, accommodates the same number of persons, and is within the same price range,
but Agent cannot
guarantee availability or comparability of other properties. If moved to another property, monies paid
and all signature
authorizations will be applied to the new reservation. If for any reason whatsoever, Guest is denied
access to the property, and
is unable to take possession by the time prescribed, Ownerβs and Agentβs liability shall be limited to
the return to Guest of all
monies paid on account. Owner and Agent are not liable for any circumstances that would prohibit or
limit the use of the property
for any reason constituting a βforce majeureβ which shall mean: a. riot, invasion, acts of foreign
enemies, acts or threats of war,
revolution, terrorism or similar disorder, b. acts of God, c. acts, orders, regulations or omissions of
or by any governmental authority
(other than orders or regulations of a governmental authority resulting from the obligated partyβs
non-compliance with typical and
ordinary health, licensing or construction laws, rules and regulations), d. floods, hurricanes,
tornadoes, fire, other physical natural
disaster, and extreme adverse weather conditions, e. outbreaks of infectious disease or any other public
health crisis including,
without limitation, any epidemic, pandemic or quarantine, f. national or regional labor disturbances
including, without limitation,
strikes, lock-outs, work stoppages or slow-downs and national or regional boycotts, and labor and
material shortages, and g. other
events and causes that are not within the control of Agent or Owner.
20. AGENCY DISCLOSURE
By Virginia Law, an Agent must notify you that Siebert Realty is employed by and
represents the
property Owner. Siebert Realty will make every effort to assist you in the selection of your vacation
rental or purchase. Subject
property may or may not be owned by a Real Estate Licensee.

21. BREACH OF LEASE
If at the sole discretion of the Agent, Guest violates any of the terms of this
Lease Agreement or
Agentβs rules and regulations, or are in Default as described in paragraph 28 below, Guest may be asked
to leave the property
without refund. Guest(s) hereby agrees to hold and save harmless Agent and Owner from damages or
injuries to person or
property by reason of any cause whatsoever, either in or about the property or elsewhere as described in
paragraph 27.
22. OCEANFRONT PROPERTIES / BEACH ACCESS
Siebert Realty cannot guarantee that an oceanfront house will
not be
bulkheaded or have sand replenishment work done sometime in the future. Not all oceanfront properties
have private beach
access. Public city access stairs are available for guest use if private stairs are not provided. Due to
changing coastal conditions,
Agent cannot guarantee the size or condition of beach, condition of bulkhead, condition of public access
stairs, or ownerβs private
stairs to the beach at any given time. In some areas, there may be times during high tide that would
limit the amount of usable
beach.
23. LEASE AGREEMENT ACCEPTANCE
Should one or more persons execute this Lease Agreement by tender of
their
payment (in lieu of signatures), all such persons, including Guest named on the lease, as well as other
members of the party
occupying the premises, shall be jointly and severally liable for all terms and conditions set forth in
this Lease Agreement.
24. DISPUTE VENUE
In the event of any controversy or dispute between parties hereto arising out of or
relating to this
reservation or breach thereof, the prevailing party shall be entitled to recover from the other party,
expenses incurred plus
reasonable attorneyβs fee and costs. Any action shall be brought to the state courts of Virginia in the
City of Virginia Beach, and
this Lease Agreement shall be deemed executed in Virginia and interpreted under and governed by Virginia
law.
25. ENTRY BY AGENT
Upon reasonable notice, Agent may enter the property to post any notices required
by law or to provide
services, inspect or repair the property. If Guest is not present Agent may enter the property by master
key. No notice of entry
shall be required in the event of an emergency or emergency repair.
26. PARKING
Only ordinary size passenger vehicles of Guest, having valid license plates, insurance,
and registration, may be
parked in the driveway of the property or parking area designated by Agent. Guest may not be permitted
to park boats, trailers,
commercial vans, campers, recreational vehicles (RVs), or commercial trucks in the driveway or outside
the Property without the
prior written consent of Agent, which consent shall be determined in Agent's sole discretion. No motor
vehicle maintenance or
repair may be performed in the driveway or in or about the Property.
27. INDEMNIFICATION
GUEST WILL INDEMNIFY, DEFEND AND HOLD HARMLESS AGENT AND OWNER FROM ANY
AND ALL DAMAGES, LIABILITIES, COSTS, EXPENSES, FINES, PENALTIES, AND OTHER LOSSES OF ANY KIND OR
NATURE INCURRED BY AGENT OR OWNER BY REASON OF (1) GUESTβS BREACH OF THIS LEASE AGREEMENT, (2)
GUESTβS VIOLATION OF ANY APPLICABLE LOCAL, STATE OR FEDERAL ORDINANCE, LAW OR RULE OR REGULATION,
INCLUDING, WITHOUT LIMITATION, ANY SUCH ORDINANCE, LAW OR RULE OR REGULATION REGARDING CONTROL
OF OR CARE FOR ANIMALS (WHETHER PETS OR ASSISTANCE ANIMALS), AND (3) PERSONAL INJURY OR PROPERTY
DAMAGE OF ANY KIND OR NATURE CAUSED BY GUESTβS WILLFUL OR NEGLIGENT ACTS OR OMISSIONS OR BY
GUESTβS ANIMALS (WHETHER PETS OR ASSISTANCE ANIMALS). GUESTβS OBLIGATIONS IN THIS PARAGRAPH SHALL
SURVIVE THE GUESTβS DEPARTURE FROM THE PROPERTY AND THE TERMINATION OF THIS LEASE AGREEMENT
AND SHALL INCLUDE, WITHOUT LIMITATION, REASONABLE ATTORNEYS' FEES AND ALL REASONABLE EXPENSES
INCURRED IN INVESTIGATING, PREPARING, OR DEFENDING AGAINST ANY LITIGATION OR INVESTIGATION,
COMMENCED, OR THREATENED, OR ANY CLAIM WHATSOEVER, UNLESS THE SAME ARISES SOLELY FROM THE
WILLFUL OR NEGLIGENT ACT(S) OR OMISSION(S) OF AGENT OR OWNER, IN WHICH CASE WHICHEVER OF AGENT
OF OWNER, OR BOTH, WAS THE SOLE CAUSE OF SUCH WILLFUL OR NEGLIGENT ACT(S) OR OMISSION(S), WILL LOSE
THE BENEFIT OF THIS INDEMNIFICATION OF THIS PARAGRAPH.
28. DEFAULT
Each of the following shall be considered a default by Guest under this Lease Agreement:
- a. permitting unauthorized persons to live at the property;
- b. serious or repeated damage to the property;
- c. creation of physical hazards;
- d. serious or repeated interference with the rights of other guests or neighbors around the property;
- e. unauthorized alteration to the property;
- f. refusing Agentβs access and entry onto the property;
- g. failure to comply with pet policies;
- h. acts by Guest, its family members, visitors, employees or agents that endanger the health, safety or
welfare of other
Guests or neighbors around the property;
- i. violation of Agentβs rules and regulations with respect to the property;
- j. violations of local, state, or federal law by Guest, its family members, visitors, employees or
agents; and,
- k. other good cause, as permitted by law.
Unless required by law, Guest shall not be entitled to any notice of or opportunity to cure any default.
Upon Guest default, Agent
may terminate this Lease Agreement and regain possession of the property by process of law. Guest shall
be responsible for all
costs and expenses incurred by Agent as a result of Guest default, including, but not limited to,
reasonable attorneysβ fees.
29. SEVERABILITY
The provisions of this Agreement shall be separate and severable. If any provision
hereof is unenforceable
or illegal, the balance of this Agreement shall remain in full force and effect.
Notice: This is a legally binding agreement. If not completely understood, seek competent advice.
UPON TENDER OF ANY PAYMENT, GUEST AGREES TO ABIDE BY THE TERMS, CONDITIONS AND POLICIES OF
LEASE AGREEMENT.
